Thames Valley Air Ambulance is licensed by the Gambling Commission to run a society lottery for its charitable purposes. A policy stating its full terms and conditions is required to ensure gifts are solicited and accepted from trustworthy sources and can be used to achieve the purposes of the charity.

This policy sets out Thames Valley Air Ambulance’s Lottery Terms and Conditions.to assist in our compliance with the Gambling Act 2005 and our Licensing Codes and Conditions of Practice (LCCP).

This policy applies to all staff and volunteers within the charity and to Lottery Fundraising Services.

The Terms and Conditions within this policy apply to all entrants in the lottery, without exception.

TVAA – Thames Valley Air Ambulance.

Gambling Commission – Regulatory body of all registered gambling activities

Charitable Purpose – What Thames Valley Air Ambulance is there to provide for beneficiaries.

Gambling Act 2005 – An Act of Parliament mainly applying to England and Wales and Scotland and designed to control all forms of gambling.

LCCP – Licensing Codes and Conditions of Practice of our Society Lottery License.

LFS – Lottery Fundraising Services Limited, an External Lottery Management company (ELM).

Terms and Conditions – The rules of participation in the TVAA lottery.

Cash Prize – Monetary prize in the weekly draw

Ticket – One chance in the weekly draw

Cleared funds – Appropriate funds received by TVAA to ensure participation.

5.1      These Terms and Conditions are the Lottery Rules of the Thames Valley Air Ambulance Lottery Draw. By entering the lottery, entrants agree to be bound by these rules. You may not accept all or any of these rules, and your participation in the draw will be cancelled if you reject any part of the following.

5.2      This lottery is being promoted by and on behalf of Thames Valley Air Ambulance.

5.3      For the purpose of the Gambling Act 2005, this lottery is defined as a “Society Lottery”.

5.4      This lottery is licensed and regulated by the Gambling Commission, License No 000-005167-N-304999-016.

5.5       To enter the draw you must be aged 16 years of age or over. It is an offence for anyone under the age of 16 years to participate in a lottery. The Charity will, where appropriate, carry out checks to verify this requirement if necessary, including seeking confirmation from relevant agencies that can provide such information.

5.6      The weekly prize are cash, although additional prizes could be offered from time to time, including a rollover. The prize fund will be 30% of total proceeds up to a maximum of £1500 per week.

5.7      All lottery entry sales are final, and no refunds shall be made at any time.  All entrants acknowledge that their payment of £1.00 per ticket to enter the lottery does not guarantee that they will win any prize.

5.8      The draw for the prizes will be made using a random number generator at the Lottery Fundraising Services premises, held weekly and witnessed by two people.  You do not need to be present at the draw to win the lottery.   5.9       Winners will receive their prizes by cheque or bank transfer no later than ten working days after the draw has taken place, addressed to the details of the player held by the lottery on the day of the draw. Winners do not have to make a claim and all prizes will be paid automatically. All winners will be notified by post.

5.10    Winning prize cheques are valid for 6 months, after such time the prizes will be subject to surrender and deemed as a donation to the charity.

5.11    Thames Valley Air Ambulance reserves the right in exceptional and unforeseen circumstances to substitute any non-cash prizes acquired for the lottery for a similar prize at Thames Valley Air Ambulances’ absolute discretion.  Thames Valley Air Ambulance also reserves the right to postpone any lottery draw for a period of no longer than 14 days: in the event of an emergency.  Details of any postponement will appear on the charity website www.tvairambulance.org.uk/support-us/lottery/

5.12    All tickets shall be priced at £1.00. Full payment for each ticket must be received either in the form of cash or cleared funds before the ticket can be entered into the draw. Only tickets for which full payment has been received either in the form of cash or cleared funds are eligible to win a prize.

5.13    The winners of the lottery prizes will be notified by either, phone, email, or letter.

5.14    All entrants are solely responsible for providing Thames Valley Air Ambulance with their accurate and up-to-date contact details and Thames Valley Air Ambulance will, in no way, be liable for any failure or inability to contact any entrant due to any errors, omissions or inaccuracies in the contact details that the entrant has provided. If an entrant changes their contact details, they will be solely responsible for advising Thames Valley Air Ambulance of the change.

5.15    By accepting the prize, the winner agrees to take part in promotional activity and Thames Valley Air Ambulance reserves the right to use the name and address of the winner, their photograph and audio and/or visual recordings of them in any publicity unless prior notification has been received. 

5.16    New members will be sent a welcome letter advising them of their randomly selected draw number(s) and a personal membership number. This communication will also include if relevant details of the Direct Debit guarantee and any other relevant information to be able to satisfy legislation.

5.17    Following cancellation of your lottery membership, you may request a refund of the left over pennies remaining on your account by contacting our lottery hotline on 0300 999 0135 or sending a written request to our lottery office. After a period of 6 weeks any remaining monies left on a player’s account will be deemed as a donation to the Charity. Membership may be cancelled at any time, although those received after 12:00 hours on a Thursday may not be actioned until after the weekly draw. To cancel please contact the lottery office on 0300 999 0135 or email us on info@tvairambulance.org.uk If members cancel, any refund of advanced payments will be at the discretion of the responsible person. Refunds will be made within 10 working days of the request being accepted.

5.18     If we are notified that a participant in the lottery is deceased, we will freeze the associated account and any unclaimed prizes if applicable. The charity will use all reasonable efforts to contact the personal representatives or executors of the entrant to establish their wishes in relation to those funds. If the charity is not able to contact the personal representatives or executors of the entrant, it may at its discretion, return the funds to the bank account registered to the entrant if payment was made by Direct Debit. If the charity is not able to return the funds to that account, it will hold the funds for six months from the date we became aware the entrant was deceased. After this time, the funds will be deemed a donation to the charity.

The personal representatives or executors may contact the charity to claim the funds at any time during the six-month period and, as long as they can provide any information the charity reasonably requires, the charity will then refund the funds. No interest will be payable in respect of monies refunded.

5.19   All monies received as advanced payments will be held in a ring-fenced bank account prior to each draw being made and will not be applied to any other use than that of funding entries into the draw prior to the draw. In the event of the society becoming insolvent no guarantee is implied or given that refunds will be made. This covers the ‘Basic’ Risk rating as identified by the Gambling Commission. 5.20    Thames Valley Air Ambulance shall not be liable to the member for any loss or damage suffered or arising from:

  • Any delays or failures in the postal service or other delivery methods used by Thames Valley Air Ambulance or the member from time to time.
  • Any delays or failures in any software or other systems used by Thames Valley Air Ambulance for the administration of the lottery.
  • Any delays or failures in the Banking system used by Thames Valley Air Ambulance or the member.
  • Any refusal by Thames Valley Air Ambulance to accept registration of an individual as a member.
  • Any failure to enter a chance into the draw.
  • Any event beyond the reasonable control of Thames Valley Air Ambulance.

5.21    Nothing within these terms and conditions shall create or should be construed as creating any form of contract between any entrant and Thames Valley Air Ambulance.

5.23    Thames Valley Air Ambulance is committed to protecting members’ privacy. 5.24    An individual has the right to access the information we hold about them. To obtain this information or if you have any questions regarding how we use your personal data, please contact DPO@tvairambulance.org.uk.

5.25    Thames Valley Air Ambulance do not sell personal data to third parties.

5.26    In the event of any dispute regarding the rules, the decision of Thames Valley Air Ambulance shall be final, and no further correspondence or discussion shall be entered into.

5.27    Thames Valley Air Ambulance employees are not permitted to play any one-off raffles organised by TVAA but are permitted to join the weekly TVAA Lottery.

5.28    Thames Valley Air Ambulance wishes to conduct its lottery in a fair and socially responsible way, and to endorse responsible gambling.  We will review the terms and conditions annually as well as updating them as required by law from time to time.

5.29    Thames Valley Air Ambulance reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these rules.

5.30    The Thames Valley Air Ambulance members responsible for the promotion and management of the lottery are the named responsible persons of Neil Harman, Director of Fundraising and John Wilcox, Head of Finance.  Responsible persons are not permitted to take part in the TVAA lottery.   Either named person can be contacted by sending an email to info@tvairambulance.org.uk.

5.31    Neither Thames Valley Air Ambulance nor our External Lottery Management company shall be liable to you in contract, tort, and negligence or otherwise for any indirect or consequential loss suffered by you in relation to your participation in the Lottery (including loss of the opportunity to enter the Lottery and / or the chance of winning a prize).

5.33    This lottery is a form of gambling and participants are encouraged to gamble sensibly. 5.35    Thames Valley Air Ambulance limits the maximum number of entries to £20 per person per week.

5.36    Should a prize winner be found to be under the age of 16 we will refund their money and withhold the prize, additionally the charity reserves the right to reclaim any prizes issued in error.

5.38    The Laws of England and Wales shall govern the interpretation and/or enforcement of these Terms and Conditions and Thames Valley Air Ambulance, and all entrants hereby submit to the exclusive jurisdiction of the English courts.
